They key steps in a one couple, one lawyer divorce…
We are proud that our family law team are taking the lead and offering the option of a one couple, one lawyer approach to divorce. This allows our clients to have even more choice throughout the divorce process, whilst reducing unwanted conflict and legal fees (as these will be shared between you both).
So, how does this new approach work and what are the key steps in the process?
Step 1 – Free initial joint meetings
The first step of a resolution together divorce is that one of our experts will arrange a free, initial meeting with you (and your partner if appropriate). In this meeting, we seek to gain an understanding of you both, and your circumstances. We then can explain how this approach works, to allow you to make an informed decision about whether it is right for you.
If you feel it may not be appropriate for you to work together then that is ok; we can talk to you about other approaches that may work better for you and your circumstances. It is also worth noting that the information disclosed in this meeting is confidential.
Step 2 – Separate meetings
Our family law team have a duty of care for all our clients. It is therefore necessary for us to meet with you separately so that we can gain an understanding of you both as individuals and discuss what you are hoping to achieve and ensure that it is appropriate and safe for you to engage with the Resolution Together way of working. This is also confidential.
Step 3 – Subsequent joint discussions and couples’ negotiation
We will then work with you both to help you reach a workable solution, together. The meetings will require transparency from both parties and information will be freely shared with your lawyer and your partner about matters relating to finances and children, as well as what the future looks like for you both.
At any point, you can obtain additional, individual legal support or advice that you may require, to then be discussed together at the meetings.
Step 4 – Reaching an outcome
Once you have reached a resolution together, your lawyer will draft a standard order which reflects your agreement. Any decisions and agreements will have been worked through and tested by you both and facilitated by your lawyer. We will also point out to you, prior to any final agreement, any aspect that might differ from what the Court would order and will also advise you of how you can apply to the Court for the draft order to be approved.
